Judge rules EPA overreached and abused its power

A federal agency is being described by a judge as bully-like while also abusing its power to stop some residential developments.

The Environmental Protection Agency learned the hard way that type of behavior won't be tolerated in Texas. 

This is after the agency sued a local construction company owner who's going by the name Jerry. 

That man, who doesn't want to be identified, says the EPA accused him of damaging jurisdictional wetlands during the construction of bender's landing in spring.

A federal judge sided with Jerry saying the EPA overreached and abused its power to limit or stop some residential developments.

Federal Judge Lynn Hughes also forced the EPA to pay Jerry's attorney's fees. A spokesman for the agency declined to comment.
