LIVE UPDATES | ICE in MN: Arrests made in protests; FBI investigating Rep. Ilhan Omar incident

MINNEAPOLIS (FOX 9) - Immigration enforcement operations are ongoing in Minnesota, and state and local officials are sharing updates on ICE activity and proposed legislation aimed at protecting constitutional rights. 

Recently, Border Czar Tom Homan arrived in Minnesota to oversee the immigration enforcement operations following the deadly shootings of Renee Good and Alex Pretti. Homan met with local leaders on Tuesday, including Gov. Tim Walz, Minneapolis Mayor Jacob Frey and Minneapolis Police Chief Brian O’Hara.

Meanwhile, new details emerged in the deadly shooting of Alex Pretti, including that two federal officers fired shots and investigators have body-camera video from at least four Border Patrol agents on scene. This comes as President Trump says he wants to see a "very honorable and honest investigation" into Pretti's death.

In a separate incident, Rep. Ilhan Omar was sprayed with an unknown liquid during a town hall event on Tuesday night, hours after Trump talked negatively about Omar in Iowa. Police arrested the man on suspicion of assault and a forensic team is investigating the liquid used in the attack.

3:30 p.m. - Second National Day of Action planned

Organizers are announcing a second "National Day of Action" protesting ongoing ICE operations that is taking place in the Twin Cities on Friday, with those participating being encouraged to skip school and work, while refraining from spending.

The event will occur on Friday, Jan. 30, one week after more than 10,000 people marched through the streets of downtown Minneapolis to the Target Center for a rally to demand ICE operations cease in Minnesota.

2:45 p.m. - Attorney General Pam Bondi announces arrest of ’16 Minnesota rioters’

U.S. Attorney General Pam Bondi posted that she is "on the ground in Minneapolis and that "Federal agents have arrested 16 Minnesota rioters for allegedly assaulting federal law enforcement — people who have been resisting and impeding our federal law enforcement agents."

She added that "more arrests" are expected to come. 

"I’ve said it before and I’ll say it again: NOTHING will stop President Trump and this Department of Justice from enforcing the law," the attorney general said. 

1:46 p.m. - House Democrats demand DHS records of federal shootings

Democrats are demanding Secretary of Homeland Security Kristi Noem "immediately produce" records related to the two Minneapolis shootings by federal officials that left Alex Pretti and Renee Good dead. The letter also demands DHS preserve all records associated with the fatal shootings.

The Committee on Homeland Security is investigating the two shootings, noting despite video evidence, "DHS and White House officials labeled the victims ‘domestic terrorists’ and have repeatedly failed to provide Congress with substantive information in response to oversight requests," a press release says. 

"In addition to our demand for immediate records production, this letter serves as notice of an ongoing congressional investigation and that you are to preserve, in accordance with all applicable Federal laws, all records relating to the use of deadly force by DHS law enforcement against any U.S. citizen." The members wrote.

"The Committee intends to closely observe the compliance of the Department—and all its component agencies—with these requirements." The members concluded.

Democrats are demanding "all video footage from both shootings, evidence supporting DHS’s claims that the victims were ‘domestic terrorists,’ information on the officers involved and their use of force histories, clarification of reports that medical aid was denied to Ms. Good, and justification for ICE’s Homeland Security Investigations leading the investigation into Mr. Pretti’s death," a news release says.

1:30 p.m. – Rep. Finke to introduce legislation to hold ICE accountable 

Minnesota Rep. Leigh Finke (DFL-St. Paul) announced plans to introduce two bills in the Minnesota House of Representatives aimed at holding federal law enforcement accountable and increasing transparency during ICE operation in the state. 

According to the announcement, one bill prohibits law enforcement from covering their faces while working, with exceptions for public health. The second bill would require vehicles used by law enforcement to transport people to be clearly marked and be equipped for safe transport.

"Minnesota should not be a place where people are abducted off the street by masked, unidentified men in unmarked vans. What we are seeing right now isn’t standard law enforcement—it is a paramilitary-style occupation that relies on fear and anonymity to bypass accountability," said Rep. Finke in a statement. "By requiring officers to show their faces and ensuring transport vehicles are clearly marked, these bills restore a basic standard of public safety: that every person in Minnesota has the right to know who is detaining them and why. Transparency from local to federal law enforcement is a fundamental protection for all Minnesotans—including our most vulnerable neighbors—against the chaos of targeted state violence. These tactics have no place in Minnesota. I am committed to using every tool in my legislative power to hold these agencies accountable and bring them back under the rule of law." 

The upcoming legislative session begins on Feb. 17. 

1:25 p.m. – Pam Bondi in Minneapolis, 16 people arrested for allegedly assaulting federal agents

United States Attorney General Pam Bondi said in a post on X that federal agents have arrested more than a dozen people in Minnesota for allegedly assaulting federal law enforcement officers. 

The social media post reads, "MINNESOTA ARRESTS — I am on the ground in Minneapolis today. Federal agents have arrested 16 Minnesota rioters for allegedly assaulting federal law enforcement — people who have been resisting and impeding our federal law enforcement agents. We expect more arrests to come. I’ve said it before and I’ll say it again: NOTHING will stop President Trump and this Department of Justice from enforcing the law."

1:15 p.m. – FBI taking over investigation into Rep. Omar attack

Minneapolis police confirmed Wednesday that the FBI is leading the investigation into the suspect who sprayed Rep. Ilhan Omar during a town hall event Tuesday night.

12:12 p.m. – Moriarty expects to have enough evidence to determine if charges are appropriate in federal shootings

Hennepin County Attorney Mary Moriarty said on Wednesday she anticipates her office will have enough evidence to determine whether charges are appropriate in the three federal officer-involved shootings in Minneapolis, including the killings of Renee Good and Alex Pretti.

Moriarty confirmed her office is still battling in court for the state investigation to continue, while federal authorities conduct their own investigations. Despite obstacles posed by the federal government, Moriarty anticipates her office will be able to collect enough evidence to make charging decisions in all three cases.

However, as FOX 9 has noted, whether the county attorney brings charges may be irrelevant. Legal experts have told FOX 9 the supremacy clause in the constitution would likely protect the federal officers from any state charges, as long as the federal officers were acting in the course of their law enforcement duties.

12:10 p.m. – Rep. Omar sprayed with ‘non-toxic’ substance

Speaking on Wednesday afternoon, Hennepin County Attorney Mary Moriarty said the preliminary investigation into the attack on Rep. Ilhan Omar shows she was sprayed with a "non-toxic" substance.

Moriarty said the case remains under investigation and the man may also face federal charges.

Noon – St. Paul Mayor Her meets with Border Czar Tom Homan 

St. Paul Mayor Kaohly Her released the following statement about meeting with White House Border Czar Tom Homan on Wednesday. 

"Today I met with Tom Homan and his team to discuss the ongoing ICE surge in Minnesota. I appreciated the opportunity to share with them the harm this surge is having in our city. I reinforced the importance of immigrants and refugees to the fabric of our community. Changing leadership and opening lines of communication with leaders in Minnesota are promising steps toward building trust, ensuring accountability to federal actions, and finding a meaningful resolution to end this surge. 

"We look forward to seeing concrete next steps as Mr. Homan meets with local officials to de-escalate the situation in Saint Paul."

10:30 a.m. – Sens. Amy Klobuchar and Tina Smith to deliver floor speeches on ICE

Senators Tina Smith and Amy Klobuchar are set to deliver remarks on the Senate Floor about Operation Metro Surge and the ongoing ICE operations in Minnesota. The speeches will take place at approximately 3 p.m. CT and can be viewed in the player above. 

"I’m taking the Senate floor to share the story of what’s happening in Minnesota at the hands of ICE and CBP – but more importantly, I’ll be imploring my colleagues (regardless of party) to use our power to rein in ICE’s lawlessness," Sen. Smith said in a post on social media. 

9:20 a.m. – Minnesota Gov. Tim Walz visits Alex Pretti memorial site

Minnesota gov. Tim Walz and his wife, Gwen, visited the memorial site for 37-year-old Alex Pretti in Minneapolis on Wednesday morning. 

"I made a promise to Alex’s parents to continue to tell his story," Gov. Walz wrote in a social media post after visiting the memorial site. "An ICU nurse at the VA, an outdoorsman, a deeply generous, compassionate friend and family member, and a true son of Minnesota. Rest in peace, Alex."

Pretti was shot and killed during an encounter with federal agents at the scene of an immigration enforcement operation on Saturday, Jan. 24. In a report to Congress, the Department of Homeland Security says two federal officers fired shots. 

8:45 a.m. – Mayor Frey responds to Trump 

Minneapolis Mayor Jacob Frey responded to President Donald Trump in a post on social media Tuesday morning. 

"The job of our police is to keep people safe, not enforce fed immigration laws. I want them preventing homicides, not hunting down a working dad who contributes to MPLS & is from Ecuador. It’s similar to the policy your guy Rudy had in NYC. Everyone should feel safe calling 911," wrote Frey. 

8:05 a.m. – President Trump says Mayor Frey is ‘playing with fire’

President Donald Trump criticized Minneapolis Mayor Jacob Frey in a post on Truth Social, saying, "Surprisingly, Mayor Jacob Frey just stated that, ‘Minneapolis does not, and will not, enforce Federal Immigration Laws.’ This is after having had a very good conversation with him. Could somebody in his inner sanctum please explain that this statement is a very serious violation of the Law, and that he is PLAYING WITH FIRE!"

6:45 a.m. – Rep. Omar assaulted at town hall 

U.S. Rep. Ilhan Omar (D-Minnesota) was sprayed with an unknown liquid by a man using a syringe during a town hall event on Tuesday night. Omar approached the man before another individual tackled him. Omar returned to the podium to continue her speech, calling for Homeland Security Secretary Kristi Noem to resign and raising the possibility of impeachment.

Omar later took to social media, saying, "I’m OK. I’m a survivor, so this small agitator isn’t going to intimidate me from doing my work. I don’t let bullies win. Grateful to my incredible constituents who rallied behind me. Minnesota strong."

Police arrested the man on suspicion of assault. A forensic team is investigating the liquid used in the attack. The man has not yet been charged as of Wednesday morning. 

6:30 – Lawmakers to talk ICE operations, constitutional rights

State and local leaders are scheduled to hold a virtual community briefing Wednesday at noon to address ICE activity in Minneapolis and planned legislation aimed at protecting constitutional rights.

According to a press release, House DFL floor leader Jamie Long, Senate President Bobby Joe Champion and Sen. Omar Fateh will discuss proposed legislation that would provide a new cause of action in state courts, giving Minnesotans a pathway to seek justice when officials violate their constitutional rights. Minneapolis City Council member Aurin Chowdhury and Hennepin County Attorney Mary Moriarty are also expected to provide community updates.
