In a District Attorney's race that's become a referendum on the incumbent's performance there's been a new development in the controversial case of a rape victim jailed against her will by Harris County Prosecutors who needed her testimony.
Attorney Sean Buckley says DA Devon Anderson's public defense of her tactics in debates and campaign statements has yielded evidence of possible mistruth and malfeasance so significant he's adding them to the rape victim's Federal lawsuit against the County.
"The statements that claim that Harris County did not have the resources to protect Jennie and to care for her, well, of course they had the resources," said Buckley. "The county just chose to spend them elsewhere."
Meanwhile at the Harris County Criminal Courthouse, fallout from another scandal continues to unfold.
Post-conviction relief was granted to a teenager who had pleaded guilty to a minor drug charge not knowing the Precinct 4 evidence in his case had been destroyed.
The public defender’s office says dozens of other misdemeanor convictions are on deck to be erased in the debacle which generated criticism of Anderson who for seven months purposely kept knowledge of the evidence destruction secret from defendants.
Cleaning up the mess will take lots of time, especially with the felony cases which require appeals court review.
"If there are 400 cases and each one of those is a two year process just getting through that many cases, it could easily take six to ten years," said Fox 26 Legal Analyst Chris Tritico.
