Houston parents battling CPS get two of their 3 kids back

Terrible. That’s how Olu Giwa describes the holidays with all three of her kids in the custody of Child Protective Services.

“I thought this day was never going to come,” an elated Giwa said Thursday after learning two of her three kids were coming back home.

It all started early last year when CPS took one of the Giwa’s twins, a boy, claiming medical neglect.
But in court hearings we attended CPS admitted they had no evidence the parents medically neglected the boy.

Then two months ago, CPS took both of their daughters into protective custody after the Giwa’s attempted to fly to Nigeria so their kids could see their terminally ill grandmother.

“The judge questioned how that presented any kind of safety concern regarding the girls,” said Kory Booth, the Giwa’s attorney.

Judge John Phillips ordered CPS to return both girls to their parents.

“He stood for the truth and he was just outstanding,” Giwa said.

However CPS is not giving up. The state agency is still pushing to have the Giwa’s parental rights terminated.

“They plan to adopt that boy out to some non- family member and the judge shook his head and basically questioned them as to how they could come to that conclusion,” Booth said.

The Giwa’s attorney says CPS has yet to offer up any evidence proving the parents had anything to do with their son’s failure to thrive.

“We’ve just been amazed, like God raising this whole army of people" Giwa said. “We’re just thankful.”

“The court has ordered the female siblings to live with their parents while CPS maintains legal custody to monitor their safety and well-being. Ali (their son) will remain in foster care to ensure that his medical needs are being met”
