Teens in court in Ava Castillo's death

Three teens appeared in probable cause court just after 9:30 a.m. on Monday to face charges in the death of four-year-old Ava Castillo.

Ferrell Dardar, 17, Marco Miller, 17, and Phillip Battles, 18, are charged with capital murder.

During the hearing on Monday morning, Harris County District Attorney's Office prosecutor Angela Weltin told a judge that Castillo died from a gunshot wound to the face.

Weltin says there's evidence that Dardar pulled the trigger. Dardar was on bond for several counts of aggravated robbery at the time that Castillo was shot.

Weltin tells FOX 26 News that Battles admitted to police that he drove the vehicle to the apartment complex where Castillo lived with her family. The prosecutor also says that at this time, Miller is believed to have participated as a lookout.

"Not only do we have a case in which they were committing a robbery when the murder happened, they killed a four-year-old child -- that also, in and of itself, is a capital murder," said Weltin.

If found guilty, Battles could face the death penalty for his involvement. Dardar and Miller could face life in prison.
