Bellaire resident Robbie Tolan  finally has his day in civil court after 7 years.

It was back in 2008 when Tolan was shot in front of his parents' Bellaire home by a Bellaire Police Department officer.

A judge has set Tuesday as the first day of Tolan's civil lawsuit against Lt. Jeff Cotton.

This comes after the Supreme Court ruled federal Judge Melinda Harmon should hear Tolan's case - a suit she initially threw out.

In the meantime, Judge Harmon dismissed Tolan's lawsuit against the City of Bellaire.
