In one of four deadly shooting in Houston Tuesday night a former Jack Yates High School basketball star was killed. He was shot nearby to where he lived with his mom where police responded to a burglary.

Just before the New Year the family of Melvin Swift is mourning his death.  Family and friends stood outside his home on Ambrose Street on the south side of Houston.

Down the block from his home on 3200 block of Jorns Street police say a family came home around 8 p.m. Tuesday night and a girl found a burglar in her room with a knife. Police say the man was shot in the foot and died at the hospital.

Swift's aunt says the family declines to comment.  According to his criminal record Swift had a theft charge dismissed in 2013.

On YouTube several videos highlight Swift's moves on the court. He went on to play at Trinity Valley Community College.

On his mother's Facebook page she posted an image with his name and angel sign. Many people responded with their condolences. And on Swift's Twitter account he posted a picture of a little girl and said his motivation.

The homeowner who shot Swift isn't facing any charges. The case will go to a grand jury.
