Elderly couple scammed from home gets 60-days without rent to vacate

SIMI VALLEY, Calif. (FOX 11) - The nightmare continues for Hank and Helen Kawecki. They had to come back to a Ventura County Courthouse on Monday because Coastal Capital Group, LLC,  a lending company that purchased their property wants them to pay rent or be evicted. 

The Kaweckis are in this situation because they say, they were scammed out of their home by their own grandson, Chadd Moore. Moore allegedly convinced the Kawecki’s to hand over the deed of their house.

They say, Moore then took out all the equity from the home, defaulted on the loans and put the house up for sale without their knowledge. Police are investigating this case as elder abuse and fraud.

Real Estate experts say this type of elder fraud is common and most cases, up to 70%, are perpetrated by family members.

When FOX 11 first aired the elderly couple’s story, Coastal Capital was trying to get Hank and Helen evicted.

A  judge ruled they could stay for the remainder of the 60-days without paying rent so they could find a new place to live.

Now ,Coastal Capital’s lawyer, John Greenwood is back in court asking the judge to order the Kaweckis to pay rent. The judge who allowed us to record audio only, denied the request. Not happy with the ruling, Greenwood told us Coastal Capital Group is losing $6,000 a month.

Meanwhile, Hank and Helen were all smiles as they walked out of the Ventura County Courthouse.  I asked them if this was a good day. They said, "It's a very good day."
